RELEASE & WAIVER OF LIABILITY FOR FARM TOURS.

I understand that my participation in a Farm Tour at Northern Roots Farm (the “Farm”) may involve inherent risks of property damage and/or personal injury to myself, others under my supervision or control, or those who accompany me. Such risks may arise from natural or manmade hazards, known and unknown, present on the Farm's premises. Farms and rural, agricultural settings often contain both seen and unforeseen or concealed dangerous conditions including (but not limited to) farm livestock, wild animals, reptiles, insects, uneven terrain, barbed-wire fencing, sharp-edged farming implements, all-terrain vehicles (ATVs), heavy equipment, and functional outbuildings in a state of decay or disrepair. By signing below, I acknowledge and assume all such risks and hazards and execute this release as to all such risks and hazards, including those perceived to be the result of the negligence of the Farm or its officers, directors, employees, managers, or agents.

I agree to be solely responsible for my own safety, the safety of any person under my supervision and control, and to take every precaution to provide for my own safety and well-being while on or using the facilities of the Farm. I understand that by signing this Waiver, I assume all risks associated with my use of Northern Roots Farm’s facilities. I release Northern Roots Farm of Georgia, LLC d/b/a Northern Roots Farm and its successors, assigns, officers, directors, employees, managers, and agents from all liability arising from such use. This release of liability extends to all claims of any kind involving or relating to property damage, bodily injury, or death suffered or sustained by myself or any other person. I hereby waive any right I might have to make claims or bring legal proceedings against Northern Roots Farm of Georgia, LLC d/b/a Northern Roots Farm or its successors, assigns, officers, directors, employees, managers, or agents or the owners or lessors of properties over which the facilities are operated for any personal injury or property damage sustained by me, any person under my supervision and control, or any person who accompanies me onto the Facilities of Northern Roots Farm. This waiver expressly extends to all claims that may result from the negligence or recklessness of Northern Roots Farm of Georgia, LLC d/b/a Northern Roots Farm or its officers, directors, employees, managers, or agents.

I agree to indemnify, defend, and hold harmless Northern Roots Farm of Georgia, LLC d/b/a Northern Roots Farm and its successors, assigns, officers, directors, employees, managers, and agents or the owners or lessors of properties over which the facilities are operated from any costs, liabilities, and attorneys’ fees which may be incurred by it in any claim or legal proceeding I might bring in contravention of this Waiver or in any such claim or legal proceeding brought by a person who is under my control or supervision or who has accompanied me onto the Facilities of Northern Roots Farm. I further agree to indemnify and hold harmless Northern Roots Farm of Georgia, LLC d/b/a Northern Roots Farm and its successors, assigns, officers, directors, employees, managers, and agents or the owners or lessors of properties over which the facilities are operated from any costs, losses, damages, and attorneys’ fees (collectively, “Damages”) suffered or incurred by Northern Roots Farm of Georgia, LLC d/b/a Northern Roots Farm or incurred by or to any persons or property located in or on Northern Roots Farm Facilities, and which Damages arise in any way out of my presence in or on the Facilities of Northern Roots Farm, or the presence of any persons under my control or supervision, or others who have accompanied me onto or into the Facilities of Northern Roots Farm which Damages arise from my acts or omissions or the acts or omissions of any such persons.

By signing below, I acknowledge that I have read this Waiver, understand it, and have voluntarily signed it for myself and/or for any children under the age of 17 who have accompanied me and are under my control and supervision.

INCLEMENT WEATHER AND CANCELLATION POLICIES

Weather conditions are naturally occurring and unpredictable at times. Northern Roots Farm reserves the right to reschedule or cancel Farm Tours in the event of severe weather conditions deemed unsafe or unsuitable for tours. In such cases, tour fees may be transferred to a rescheduled tour within six months from the date of the original booking. If a tour proceeds despite adverse weather conditions, participants acknowledge that weather conditions may limit the quality and enjoyment of the tour. All participants are responsible for their personal belongings, and Northern Roots Farm shall not be responsible for damage to personal property resulting from weather or any condition or characteristic of the farm property.

Cancellation Policy: Participants may cancel a Farm Tour by providing notice to the booking agent via text message or email no later than 24 hours prior to the scheduled tour time, in which case the nonrefundable tour fee may be applied to another tour booked within six months from the date of the original booking. Participants shall forfeit the tour fee for any tour canceled less than 24 hours from its scheduled start time or in the case of a no-show.

By signing below, I acknowledge that I have read this Waiver, understand it, and have voluntarily signed it for myself and/or for any children under the age of 17 who have accompanied me and are under my control and supervision.
